1.申請驗證作業說明

 

1. 本局係依據「管理系統驗證實施辦法」(中華民國91年01月09日經濟部經標字第 09004628880 號令訂定發布全文18 條。中華民國94年01月13日經標字第09304610120號令修正發布第2條、第9條、第13條、第16條及第17條;增訂第10-1條條文),辦理各類管理系統驗證業務,內容請參閱本局網站http://www.bsmi.gov.tw之相關法規區。

 

1. Description of certification services

BSMI (Bureau of Standards, Metrology, and Inspection, MOEA) provides management system certification services in accordance with the requirements prescribed in the 18 articles contained in jin-biao-tzu No. 09004628880 ordinance promulgated by MOEA on January 9, 2012, in Articles 2, 9, 13, 16, 17 and in the Updated Article 10-1 contained in jin-biao-tzu No. 09304610120 ordinance promulgated by MOEA on January 13, 2015. 1.1管理系統驗證標準

依據「管理系統驗證實施辦法」第3條第2項規定指定:

(1) ISO 9001:2008為品質管理系統(QMS)驗證標準;

(2) ISO 14001:2004為環境管理系統(EMS)驗證標準;

(3) OHSAS 18001:2007為職業安全衛生管理系統(OHSMS)驗證標準;

(4) TOSHMS:為臺灣職業安全衛生管理系統(TOSHMS)驗證標準;

(5) ISO 27001:2005為資訊安全管理系統(ISMS)驗證標準;

(6) ISO 22000:2005為食品安全管理系統(FSMS)驗證標準。

1.1 Criteria for management system certification services

Management system certification services are provided in compliance with the requirements stated in Paragraph 2, Article  3 of Management System Certification Implementation Measures prescribed hereunder:

(1) ISO 9001:2008 for Quality Management System (QMS) certification;

(2) ISO 14001:2004 for Environment Management System (EMS) certification;

(3) OHSAS 18001:2007 for Occupational Health and Safety Management System (OHSMS) certification;

(4) TOSHMS: for Taiwan Occupational Safety and Health Management System (TOSHMS) certification;

(5) ISO 27001:2005 for Information Security Management System (ISMS) certification; and

(6) ISO 22000:2005 for Food Safety Management System (FSMS) certification.

 

1.2管理系統驗證之公正性、中立性與保密性

1.2.1本局之驗證作業,秉持公正、中立、無歧視待遇為原則。不因申請者財務情況、規模大小或為某團體之會員而有所差異,亦不得對特定廠商予以加速或延遲辦理。

1.2.2參與本局管理系統驗證作業之各委員會及各級人員,不受任何商業、財務及其他壓力而影響驗證過程或結果,亦不得直接或間接提供廠商設計、執行或維持其管理系統制度之服務。

1.2.3本局從事管理系統驗證作業所有階層之人員(包含評審人員及各單位(含外聘及受託機構)業務承辦人員),皆確保業務機密,對於驗證過程中所獲之任何資訊,不得對外洩露。應避免任何造成利益衝突之情事,包括來自本局各級人員(含受託機構人員)、或任何外部機構/人員涉及與驗證活動相關之影響行為或關切(例如:來自於所有權、管轄、管理、人員、共用資源、財務、合約、行銷,以及給付新申請廠商介紹銷售佣金或其他好處等)。若有任何造成利益衝突之情況,應予記載及分析,並就該項威脅視情況採取必要因應措施以消除或減至最小。

1.2.4不涉入任何廠商與顧問公司間之輔導/顧問服務(包含內部稽核),避免公正性之威脅。

 

1.2 The impartiality, neutrality, and confidentiality of the management system certification

1.2.1 BSMI provides all applicants with certification services impartially, neutrally, and confidentially with no discrimination whatsoever. All applicants are treated equally regardless of their financial standings, business sizes or memberships affiliated to whatever organization. BSMI shall not accelerate or decelerate the process under any circumstance.

1.2.2 All committees and staffs engaged in the certification services on behalf of BSMI are prohibited from impairing the process or validation results under any pressure such as business interest and economic interest. No committee and no staff are permitted to design, execute or maintain the management system for or on behalf of the Applicant either directly or indirectly under any circumstance.

1.2.3 All staffs engaged in the certification services on behalf of BSMI, including but not limited to all reviewers and all personnel involved in the certification process (including all organizations employed by or appointed by BSMI), shall be obligated to treat all information pertinent to the certification confidentially and shall not disclose any information obtained from the validation process to any outsider. No interest conflict is allowed under any circumstance, including but not limited to all conducts related to interest conflict during the certificaiton process (e.g. commissions, kickbacks or any other benefits related to ownership, jurisdiction, management, personnel, common resources, financial, contract, marketing, and all other benefits related to the Applicant) in which any BSMI staff (including the staffs employed by the organizations appointed by BSMI) or outside organizations/personnel are involved. All possible interest conflicts have to be recorded and analyzed truthfully, and appropriate countermeasures have to be taken in order to eliminate or minimize all such possible interest conflicts.

1.2.4 BSMI shall not intervene in the assistance/consultation relationships (including internal auditing) between the Applicant and its consultation firms in order to maintain its impartial position.

 

1.3管理系統驗證服務之權利與義務

有關 ISO 9001/ISO 14001/OHSAS 18001/TOSHMS /ISO 27001/ ISO 22000 驗證過程中申請/登錄廠商與本局雙方之權利與義務,係規範於「管理系統驗證服務之權利與義務聲明書」;廠商申請ISO 9001/ ISO 14001/OHSAS 18001/TOSHMS /ISO 27001/ ISO 22000驗證需簽署該份文件(參閱附錄1)。

1.3 The rights and obligations associated with management system certification services.

All rights and obligations associated with ISO 9001/ISO 14001/OHSAS 18001/TOSHMS /ISO 27001/ ISO 22000 certification services are specified in the Statement of the Rights and Obligations associated with Management System Certification Services signed by and between the Applicant / the Corporation to be registered and BSMI. All applicants are required to sign the aforesaid Statement when they apply for ISO 9001/ ISO 14001/OHSAS 18001/TOSHMS /ISO 27001/ ISO 22000 certification services. (Please refer to Attachment 1 for details.
